Terms and Conditions

The undersigned (hereinafter called the ‘Applicant’) hereby applies for membership and/or electric service and agrees to purchase electric energy from Moreau-Grand Electric Cooperative, Inc., (hereinafter called the “Cooperative”), upon the following terms and conditions:

The applicant will pay the cooperative the appropriate fee set by policy, which will be a connection fee.
The applicant will, when electric energy becomes available, purchase from the cooperative the energy (electric) used on the premises described below and will pay therefore at the rates to be determined from time to time in accordance with the bylaws of the cooperative, it being understood that all amounts paid by the applicant in excess of operating costs and expenses of the cooperative properly chargeable against the furnishings of such electric energy are furnished by him as capital; the applicant will pay the established minimum bill each month regardless of the kilowatt hours consumed.
The applicant will cause his premises to be wired in accordance with wiring specifications approved by the cooperative, and the wiring specifications promulgated by the South Dakota Electrical Board and will comply with NESC (National Electric Safety Code).
The applicant will comply with and be bound by the provisions of the articles of incorporation and bylaws of the cooperative, and such rules and regulations as may be from time to time adopted by the cooperative. The applicant understands that the Articles of Incorporation and the Bylaws may from time to time be amended or restated. The applicant hereby agrees that such Articles or Bylaws do not constitute a guaranty of future benefits or conditions and shall not be construed to constitute a contract with the member to provide future benefits. The applicant agrees that any future amendments or Bylaws to the Articles of Incorporation may be enacted and the same as modified or amended shall supersede any prior Bylaw or Article of Incorporation. The Articles of Incorporation and Bylaws shall not be deemed to vest with the member any future benefits or be considered a contract with the member to provide future benefits or services.
The applicant, by becoming a member, assumes no personal liability or responsibility for any debts or liabilities of the cooperative and is expressly understood that under the law his private property is exempt from execution for any such debts or liabilities.
The applicant will receive a subscription to Moreau-Grand Electric Cooperative Connections as part of their electric cooperative membership. The subscription rate is $.50 per month and is figured into the monthly electric payment.
All poles, wire and related facilities required to extend the service shall be installed by and remain the property of the Cooperative. Moreau-Grand has the option to retire line if not connected for a set period of time as set by policy, to relocate or add to existing facilities, the option to trim or remove trees, and the need for backup generation for special needs.

The acceptance of this application by the cooperative shall constitute an agreement between the applicant and the Cooperative, and the contract for electric service shall continue in force for as long as the applicant continues to receive service.
